Little Layers — Terms of Use

1. Who we are
Little Layers is operated by Home Stretch Technology LTD ("we", "us", "Little Layers"). You can contact us at hello@littlelayers.co.
2. What Little Layers is — and what it is not
2.1 Little Layers provides general information about dressing babies and children for sleep and daily activities, based on the weather, the room temperature you tell us about, and the profile details you provide.
2.2 Little Layers is not a medical service, a healthcare provider, or a substitute for professional advice. Nothing in the app is medical advice, a diagnosis, or individual clinical guidance for your child. Our suggestions are general in nature and cannot take account of your child's health, medical conditions, development, or individual circumstances.
2.3 Our guidance is informed by publicly available safer-sleep information from sources including the NHS and The Lullaby Trust. We are not affiliated with, endorsed by, or approved by the NHS or The Lullaby Trust, and our suggestions are our own interpretation of general guidance, not theirs.
2.4 Every child is different. Premature babies, babies with a low birth weight, and children with any medical condition may have needs our general suggestions do not reflect, even where the app asks about these factors. If your child is unwell, was born prematurely, has any health condition, or you are worried about them in any way, speak to your midwife, health visitor, GP, or call NHS 111. In an emergency call 999.
3. You remain responsible for your child
3.1 You, the parent or carer, remain solely responsible at all times for decisions about your child's clothing, bedding, sleeping environment, and care. Our suggestions are a starting point for your own judgement, not a replacement for it.
3.2 You are responsible for the accuracy of the information you give us. Our suggestions are calculated from what you enter — including your child's date of birth, whether they were born early, their sleep setup, and the room temperature. If that information is wrong or out of date, the suggestions will be too.
3.3 You should always check your child directly. Feel their chest or the back of their neck to judge whether they are too hot or too cold, check on them regularly, and follow safer-sleep practices (including sleeping babies on their backs in a clear cot). The app cannot see, monitor, or assess your child.
3.4 Weather data and any estimated indoor temperatures are approximate. Weather forecasts come from third-party providers and can be wrong; homes vary enormously. Where we estimate an indoor temperature, it is a general assumption, not a measurement. We recommend using a room thermometer.
4. Acceptable use
4.1 You must be at least 18 to create an account. The app is designed for parents and carers of children aged 0–5.
4.2 You agree not to misuse the service, attempt to access it by automated means, resell it, or use it for any purpose other than caring for children in your care.
5. Accounts and subscriptions
5.1 Some features are free; others require a paid subscription billed through our payment provider (Stripe). Prices and what's included are shown in the app and on our website.
5.2 Subscriptions renew automatically until cancelled. You can cancel at any time, effective at the end of the current billing period. Where you subscribe via our website, statutory cancellation rights under the Consumer Contracts Regulations 2013 apply.
5.3 We may change prices or features with reasonable notice; changes take effect at your next renewal.
6. Service availability and changes
6.1 We aim to keep the app available and accurate but do not guarantee uninterrupted access. Suggestions depend on third-party weather services which may be unavailable or inaccurate.
6.2 We regularly review and update our guidance content. Suggestions may change as guidance evolves; historical suggestions reflect the guidance at the time they were generated.
7. Liability
7.1 Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of England and Wales.
7.2 Subject to clause 7.1, we are not liable for: losses caused by inaccurate information you provide; losses caused by third-party services (including weather data and payment processing) beyond our reasonable control; your use of suggestions contrary to the guidance in clauses 2 and 3; or losses that were not a foreseeable result of our breach of these terms.
7.3 Subject to clause 7.1, our total liability to you in connection with the service is limited to the greater of £100 and the amount you have paid us in the 12 months before the claim arose.
7.4 Nothing in these terms affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015 to a service performed with reasonable care and skill.
8. Your data
Our Privacy Policy at [link] explains how we handle your and your child's information. Child profile data is provided by you, used to generate suggestions, and handled as described there.
9. Intellectual property
The app, its content, guidance framework, and branding belong to us or our licensors. You may use them only through the app for personal, non-commercial purposes.
10. Ending these terms
You can stop using the service and delete your account at any time. We may suspend or end accounts that breach these terms. Clauses that by their nature should survive (including 7) survive termination.
11. General
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction (if you live in Scotland or Northern Ireland, you may also bring proceedings there). If any part of these terms is found unenforceable, the rest remains in effect. We may update these terms; material changes will be notified in-app and apply from the stated date.
